There is increasing interest in the potential for mediation to resolve investor-State disputes. Modern investment treaties often contain specific provisions on the use of mediation to settle disputes, and there is a growing body of research on the benefits and outcomes of mediation in this field.
This interactive, practice-based investor-State mediator training is designed and organized jointly by the Centre for Effective Dispute Resolution (CEDR), the International Centre for Settlement of Investment Disputes (ICSID), the International Mediation Institute (IMI) and the International Energy Charter. It is intended to give investor-State dispute resolution practitioners and experienced mediators knowledge of the context, framework and practice of investor-State disputes, and will provide participants with the skills to mediate investment disputes.
In the first part of the course, participants with a grounding in investor-State dispute settlement (ISDS) will learn about mediation skills and process, while those with a mediation background will focus on the context and frameworks associated with ISDS. These two work-streams will come together in the second half of the course, as attention turns towards specific process and design considerations in investor-State mediation.
Participants that successfully complete the course will receive a certificate in investor-State mediation. Investor-State dispute resolution practitioners who complete this course will have the opportunity to attend the Fast Track CEDR Mediation Accreditation Course to receive the internationally recognised CEDR accreditation.
