The Energy Charter Secretariat organised a Roundtable addressed to delegations from the Contracting Parties interested in the implementation of investor state dispute settlement under the Energy Charter Treaty.
Participants shared their experience with a view of identifying instruments and actions to ensure a transparent implementation of the Energy Charter Treaty which is both favourable to energy investments and to host states. Invited speakers kicked-off the discussion with brief presentations.
The roundtable aimed at bringing an update on the publicly available information on proceedings and awards under the Energy Charter Treaty and in discussing their modernisation, including: transparency, denial of benefits, mediation/conciliation.
The discussion addressed implications for intra-EU investment disputes under the Energy Charter Treaty which arise from the proceedings brought by the EU Commission against EU Member States in relation to intra-EU Bilateral Investment Treaties.
Participants were invited to discuss the tools of the EU ‘energy and climate diplomacy’ and energy market access rules under bilateral investment and trade agreements and/or under a supplementary protocol to the Energy Charter Treaty.
