The Energy Charter Secretariat ("ECS") maintains this website ("Site") as a courtesy to those who may choose to access the Site ("Users"). The information presented herein is for informative purposes only. The ECS grants permission to Users to visit the Site and to download and copy the information, documents and materials (collectively, "Materials") from the Site subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to specific Materials within this Site.

The ECS reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any Materials in any respect. The ECS shall have no obligation to take the needs of any User into consideration in connection therewith.

The ECS reserves the right to deny in its sole discretion any Users access to this Site or any portion thereof without notice.

Disclaimer

The ECS maintains this Site to enhance public access to information about the Energy Charter Treaty, the Energy Charter Process and the activities of the Energy Charter Secretariat (“Information”).

The ECS provides the Information (including the ECS website) on an “as is” and “as available” basis. The ECS’ goal is to keep the Information accurate and complete, but it makes no representations, guarantees or warranties (express, implied or otherwise) of any kind concerning the Information, including, without limitation, no warranties of satisfactory quality, availability, fitness for a particular purpose, accuracy, completeness, merchantability, up-to-datedness, title or against infringement of the proprietary or other rights of third parties. The ECS reserves its right to change, update or discontinue in any way part or all of the Information or change any publication or data release dates, without notice or any liability.

The Information is not intended to be and should not be relied upon by you in making (or refraining from making) any decisions. The ECS shall not, under any circumstances, be liable to you for any loss, damage, liability or expense incurred or suffered (including all loss of profit, loss of use, loss of revenue, loss of contracts, increased costs and expenses and all special, indirect and consequential losses) which is claimed to result from access (or lack of access) to, use of, or reliance on, the Information, including without limitation, from any fault, error, omission, interruption or delay in such respect. Use of the Information is at the Subscriber’s, any User’s and your sole risk.

You shall indemnify and hold harmless the ECS from and against any and all loss, including loss of reputation, loss of data and loss of revenue and any other claims, actions, damages and costs occasioned to, or suffered by, the ECS resulting from your use of any Information.

Except where expressly stated, the Information does not necessarily represent the views or policies of the ECS and/or individual Member countries. The Information does not imply the expression of any opinion whatsoever on the part of the ECS concerning the legal status of any country or of its authorities. The Information and any maps included in it are without prejudice to the status of or sovereignty over any territory, to the delimitation of international frontiers and boundaries and to the name of any territory, city or area.

The ECS may mention or refer to specific companies, certain products or information on external websites. This does not imply ECS endorsement, preference or recommendation in such respect. Reliance on this third party material is at your sole risk.

The ECS reserves the right at its sole discretion to deny any access to the ECS Site or any portion of it without notice. For site security purposes and to ensure that the ECS Site remains available to all users, we may employ software programmes to monitor network traffic to identify unauthorised attempts to upload or change Information, or otherwise cause damage and to detect other possible security breaches.

Some of the Materials in the Site may contain Materials from third parties or references thereto whose copyright the User of the Site must honour by obtaining the necessary permission from the copyright owner.

Privacy Protection Policy

Introduction

The Energy Charter Secretariat (“ECS”, "us", "we", or "our") operates this website (the "Site"). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site. We use your Personal Information only for providing and improving the Site. The ECS respects and protects the privacy of Users of our Site. We undertake to ensure that any personal information you may submit to us remains private and is used only in strict accordance with this privacy policy statement. By using the Site, you agree to the collection and use of information in accordance with this policy.

In using the ECS Site and any of the text, multimedia, data or other content made available on or through this website (together also the "Information"), you acknowledge that you have fully read and understood, and agree to be bound by, these Terms of Use and the Privacy Protection Policy. Furthermore, you acknowledge and agree that the Information is the valuable property of the ECS, and the ECS retains copyright, database rights and any other applicable intellectual property rights in the Information.

Information Collection and Use

In general, you can browse the ECS Site without disclosing any information about yourself. If you visit the ECS Site to read or download information, we collect and store only the following information through ©Google Analytics: the date and time, the originating IP address, the domain name, the type of browser and operating system used (if provided by the browser), the URL of the referring page (if provided by the browser), the object requested and the completion status of the request. This information is automatically recognised and is collected for the purposes of website traffic analysis, technical support and for securing and maintaining the ECS Site. The information is anonymously recorded and it is used and analysed only at an aggregate level; none of it is reviewed at an individual level.

Log Data

For the purposes of Site traffic analysis, and to protect against possible intrusion, a log of all visits to the Site is maintained. Like many site operators, we collect information that your browser sends whenever you visit our Site ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. Other than the IP address of the visitor's browser, the information recorded is entirely anonymous. In addition, we may use third party services such as ©Google Analytics that collect, monitor and analyse these data.

Communications through the public Site

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information related to the work of the ECS through the Site. 

Users of the Site are invited to register their e-mail address on-line to receive various ECS newsletters, or notification of new ECS publications. These e-mail address registers are used only for the specific advertised purpose, and will never be disclosed to third parties. A User can at any time remove his/her e-mail address from these registers.

Registering on the ECS website is optional. If you choose not to register or provide personal information, you can still use the ECS website. If you choose to register, the information will be used only for the specific stated purpose and will never be disclosed to third parties. You can choose at any time to unsubscribe from the Site yourself or by sending an email to info@encharter.org and your name and email address will be deleted from our registers.

No information concerning Users of this Site will be disclosed to third parties. The information will only be used for the specific purpose for which it was collected. All ECS employees and other agents who have access to the personal data stored on the Site are obliged to respect the confidentiality of such data.

We will make a genuine effort to respond in a timely manner to your requests or to correct inaccuracies in your personal information. At any time, you may request that we delete or correct your personal information in our registers. For such requests, please contact info@encharter.org.

Communications with delegates

We may use your Personal Information to contact you with information related to the work of the ECS, such as meetings, documents and others. 

Delegates are invited to access their Profile created in the protected area of the Site (“Delegates area”) to access information specifically aimed at direct communication between the ECS and delegates related to the work of the ECS. Your Personal Information is strictly used for this specific purposes, and will never be disclosed to third parties. A Delegate can at any time update/modify/delete his/her profile from our register.

No information concerning delegates will be disclosed to third parties. The information will only be used for the specific purpose for which it was collected. All ECS employees and other agents who have access to the personal data stored on the Site are obliged to respect the confidentiality of such data.

We will make a genuine effort to respond in a timely manner to your requests or to correct inaccuracies in your Profile information. 

Cookies

Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your computer's hard drive. Like many sites, we might use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.

Security

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

We are committed to keeping your information confidential; however, we sometimes use third parties to provide services on our behalf.

Changes to this Privacy Policy

This Privacy Policy is effective as of 12 September 2016 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
